Terms of Service
Last updated: 2026. By using the Flykup platform, you agree to these terms.
1. Platform Overview
Flykup is a live commerce platform that enables sellers to sell products through live video, shoppable video, and direct checkout. Flykup operates as a platform intermediary — it does not manufacture, store, or take title to products sold through the platform. Flykup charges a flat subscription fee to sellers and takes zero commission on sales.
2. Seller Obligations
Sellers on Flykup must provide accurate product descriptions, prices, and stock information. Sellers are responsible for fulfilling orders within the stated dispatch timeline. Sellers must comply with applicable Indian laws including GST registration requirements, Consumer Protection Act provisions, and applicable trade regulations.
3. Prohibited Content and Products
Sellers may not list counterfeit products, products that infringe intellectual property rights, prohibited substances, weapons, or any product or content that violates Indian law. Flykup reserves the right to remove listings and suspend accounts that violate these prohibitions without refund of subscription fees.
4. Payments and Payouts
Buyer payments are processed through Razorpay or PayU and held in an Axis Bank regulated nodal account. Payouts to sellers are initiated within 48 hours of order confirmation, subject to dispute hold provisions. Payment gateway fees of approximately 2% are charged to sellers and passed through at cost with no markup.
5. Disputes
Disputes between buyers and sellers are resolved through Flykup's evidence-based process described in full at flykup.in/how-payments-work. Flykup's dispute decisions are final for amounts within platform jurisdiction. Larger commercial disputes are subject to arbitration under Indian Arbitration and Conciliation Act, 1996, with seat of arbitration in Coimbatore, Tamil Nadu.
6. Subscription and Cancellation
Flykup subscriptions are month-to-month. There are no lock-in periods and no cancellation fees. Cancellation takes effect at the end of the current billing period. Seller data remains accessible for 90 days following cancellation for export purposes.
7. Limitation of Liability
Flykup's liability to any seller or buyer is limited to the subscription fees paid in the preceding 3 months. Flykup is not liable for seller product quality, fulfillment failures, or losses arising from buyer disputes where the seller failed to provide required evidence.
8. Governing Law
These terms are governed by the laws of India. Jurisdiction for any legal proceedings is the courts of Coimbatore, Tamil Nadu, India.
